DPS to recommend criminally negligent homicide charge in Thanksgiving Day pileup

BEAUMONT - by Justin Hinton - KFDM News has obtained an accident investigation report from the Department of Public Safety indicating the DPS will recommend that the Jefferson County District Attorney file felony criminal charges in one of the 18 crashes that took place in the massive Thanksgiving Day pileup on Interstate 10.


The focus of the investigation: the man troopers say was behind the wheel of a tractor trailer that crashed into an SUV and killed a Southeast Texas couple.



According to the crash report, the DPS is recommending a charge of criminally negligent homicide against a 32-year-old man from Florida. The report lists the man as the driver of a tractor trailer that was involved in the early Thanksgiving morning crash on I-10 near Hamshire.


The report indicates the driver and a passenger were in a Freightliner owned by a company out of Indiana.


It states the driver couldn't control his speed and hit the cable barrier.


That caused the rig to fly into the air and hit a Chevy Suburban carrying Vincent Leggio and his wife Debra, killing them instantly.


Troopers say they expect to present their investigation to the Jefferson County District Attorney's Office within seven to ten days.


The D.A.'s Office will then decide whether to file charges or take the case to a grand jury.


Criminally Negligent Homicide is a State Jail Felony. If convicted it can lead to a punishment ranging from probation to up to 2 years in state jail.
